Licensees in possession of irradiating apparatuses to transfer their irradiating apparatuses

As required by Regulation 7(1) of the Radiation (Control of Irradiating Apparatus) Regulations (Cap 303B, Laws of Hong Kong), a licensee in possession of an irradiating apparatus shall only sell or transfer its irradiating apparatus to a person holding a licence in respect of that apparatus.  Failing to do so contravenes Regulation 7(1) of Cap 303B.  Any person who contravenes Regulation 7(1) shall be guilty of an offence and be liable on conviction to a fine at level 4 (presently $25,000).

In order to comply with Regulation 7(1) of Cap 303B, if a licensee in possession of an irradiating apparatus intends to sell or transfer its irradiating apparatus to another person (“the transferee”), the licensee must ensure that the transferee has already obtained the necessary irradiating apparatus licence issued under the Radiation Ordinance allowing the possession of the irradiating apparatus by the transferee.

The licensee (as the transferor of the irradiating apparatus) and the transferee will need to complete the “Transfer of Irradiating Apparatus” Form and submit the completed Form to the Radiation Board in accordance with the instruction provided in the Form.  The “Transfer of Irradiating Apparatus” Form (Form IA-TRAN) can be downloaded from the Radiation Board website at https://www.rbhk.org.hk/docs/ia-tran.pdf .
